These Terms of Service ("Terms") govern your access to and use of the BookRentManage platform, website, applications, software, artificial intelligence tools, integrations, APIs, content, and related services (collectively, the "Services") provided by BookRentManage ("BookRentManage," "Company," "we," "our," or "us").

By creating an account, accessing, subscribing to, or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.

BookRentManage continuously evolves and reserves the right to modify, update, discontinue, add, or remove features at any time without notice.

The Services are provided solely for informational and operational purposes.

BookRentManage does not provide:

  • Legal advice
  • Tax advice
  • Accounting advice
  • Financial advice
  • Investment advice
  • Employment advice
  • Regulatory compliance advice
  • Medical advice

BookRentManage does not guarantee any specific business outcome.

The Company expressly disclaims any guarantee regarding:

  • Return on ad spend
  • Marketing success
  • Search engine rankings
  • Conversion rates
  • Customer acquisition
  • Customer retention
  • Operational efficiency
  • Cost savings
  • Profitability

Past performance, examples, case studies, projections, demonstrations, simulations, or recommendations are not guarantees of future results.

User Responsibilities

You remain solely responsible for:

BookRentManage is not responsible for:

  • Platform outages
  • Account suspensions
  • Policy changes
  • Data loss
  • Algorithm updates
  • Pricing changes
  • Third-party software defects

Your use of third-party services remains subject to their respective terms and conditions.

Automations

Certain Services may enable automations, workflow actions, recommendations, or integrations capable of affecting business operations.

You acknowledge that:

  • Automated actions require human oversight.

Subscriptions and Billing

Certain Services are offered through recurring subscription plans.

By subscribing, you authorize BookRentManage to charge your payment method for all applicable fees.

Subscriptions automatically renew unless canceled before the renewal date.

Unless otherwise stated:

  • Fees are non-refundable.
  • Partial months are not prorated.
  • Unused subscription periods are not refundable.
  • Failure to pay fees may result in suspension or termination of Services.

BookRentManage reserves the right to modify pricing upon notice.

Intellectual Property

All rights, title, and interest in and to the Services remain the exclusive property of BookRentManage and its licensors.

This includes:

  • Source code
  • Trademarks
  • Logos
  • Designs
  • User interfaces
  • Databases
  • Documentation
  • Proprietary methodologies

Except as expressly permitted, you may not:

  • Copy
  • Modify
  • Reverse engineer
  • Distribute
  • Sell
  • License
  • Create derivative works

without BookRentManage's prior written consent.

Acceptable Use

You agree not to:

  • Violate applicable laws
  • Engage in fraudulent conduct
  • Infringe intellectual property rights
  • Upload malicious software
  • Circumvent security measures
  • Access unauthorized systems
  • Generate spam
  • Harass others
  • Disseminate unlawful content
  • Misrepresent BookRentManage outputs as guaranteed facts

BookRentManage reserves the right to suspend or terminate accounts violating these provisions.

Beta Features

The Services may include beta, experimental, preview, or early-access features.

Such features are provided strictly "AS IS" and may:

  • Contain bugs
  • Experience downtime
  • Produce inaccurate results
  • Be discontinued without notice

BookRentManage assumes no liability regarding beta features.

Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

BookRentManage DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY
  • RELIABILITY
  • PERFORMANCE
  • SECURITY
  • AVAILABILITY

BookRentManage DOES NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, OR COMPLETELY SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BookRentManage, BookRentManage, ITS OWNERS, MEMBERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR:

  • Lost profits
  • Lost revenue
  • Lost business opportunities
  • Lost data
  • Business interruption
  • Reputational harm
  • Indirect damages
  • Incidental damages
  • Consequential damages
  • Special damages
  • Punitive damages

REGARDLESS OF THE LEGAL THEORY ASSERTED.

Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BookRentManage'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF:

  • (A) ONE HUNDRED U.S. DOLLARS ($100); OR
  • (B) THE TOTAL AMOUNT PAID BY YOU TO BookRentManage DURING THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Indemnification

You agree to defend, indemnify, and hold harmless BookRentManage, BookRentManage, its affiliates, officers, directors, employees, contractors, licensors, and agents from any claims, damages, liabilities, losses, costs, expenses, and attorneys' fees arising from:

  • Your use of the Services
  • Your User Content
  • Your business decisions
  • Your implementation of BookRentManage recommendations
  • Violations of these Terms
  • Violations of applicable law
  • Third-party claims related to your use of the Services

Termination

BookRentManage may suspend or terminate access to the Services at any time for any reason, including violations of these Terms.

Upon termination:

  • Your access to the Services may cease immediately.
  • Outstanding payment obligations remain due.
  • Provisions intended to survive termination shall remain in effect.

Governing Law

These Terms shall be governed by and construed under the laws of the State of Delaware, United States, without regard to conflict-of-law principles.

Dispute Resolution

Any dispute arising from these Terms or the Services shall be resolved through binding arbitration conducted in the State of Delaware, United States.

You waive any right to:

  • Jury trial
  • Class action litigation
  • Representative proceedings

Claims must be brought individually.

Force Majeure

BookRentManage shall not be liable for delays or failures caused by events beyond its reasonable control, including:

  • Internet outages
  • Cloud provider failures
  • Cyberattacks
  • Government actions
  • Natural disasters
  • Labor disputes
  • Third-party service interruptions

Modifications to Terms

BookRentManage may modify these Terms at any time.

Updated Terms become effective upon posting.

Continued use of the Services constitutes acceptance of revised Terms.

Entire Agreement

These Terms constitute the entire agreement between you and BookRentManage concerning the Services and supersede all prior agreements, communications, and understandings.

Operator and Rental Responsibilities

If you use BookRentManage as a rental operator, you are responsible for the accuracy of listings, pricing, availability, guest communications, and compliance with local rental, consumer, and tax laws applicable to your business.
